    • In these Terms & Conditions, “Musthavz”, “we”, “us” and “our” refer to TeleQare Europe B.V. “Customer”, “you” and “your” refer to the consumer purchasing a product through the Musthavz website.


    Article 2 — Applicability

    1. These Terms & Conditions apply to every offer made through the Musthavz website and to every agreement concluded between Musthavz and a consumer.
    2. Before placing an order, you will be given the opportunity to read and accept these Terms & Conditions.
    3. These Terms & Conditions will be made available in a format that allows you to save or print them.
    4. Any deviation from these Terms & Conditions is valid only when agreed with us in writing.
    5. Your statutory consumer rights remain unaffected by these Terms & Conditions.


    Article 3 — Products and Offers

    1. We aim to describe and display our products as accurately as possible.
    2. Product images are intended to provide a reliable representation. Minor differences in colour may occur due to screen settings, lighting or production variations.
    3. Product specifications, compatibility information, dimensions, materials and other important characteristics are stated on the relevant product page.
    4. You are responsible for checking whether a product is suitable and compatible with your device before placing an order.
    5. Obvious typographical, technical or pricing errors do not bind Musthavz. If such an error affects an order, we will inform you and give you the choice to confirm the order at the correct price or cancel it for a full refund.
    6. Offers are valid while displayed on the website and while stocks last, unless otherwise stated.


    Article 4 — Orders and Formation of the Agreement

    1. An agreement is formed when you place an order, complete the payment process and receive an order confirmation from us by email.
    2. Before completing the order, you will be able to review and correct the information you have entered.
    3. After placing your order, you will receive an electronic confirmation containing the order details and the information required by law.
    4. We may refuse or cancel an order when:
    • the product is unavailable
    • the payment cannot be authorised
    • the delivery information is incomplete or clearly incorrect
    • there is a clear pricing or technical error
    • we reasonably suspect fraud, misuse or unlawful activity

    -If we cancel an order after payment, we will refund the amount paid as soon as possible using the original payment method.


    Article 5 — Prices and Payment

    1. All consumer prices displayed on the Musthavz website include VAT, unless explicitly stated otherwise.
    2. Any delivery or additional costs will be clearly shown before you place the order.
    3. The available payment methods are displayed during checkout.
    4. Payment must be completed using one of the payment methods offered on the website.
    5. You are responsible for providing complete and accurate payment and billing information.
    6. We will not charge costs for a payment method unless this is legally permitted and clearly disclosed before you place the order.


    Article 6 — Delivery

    1. We deliver to the countries and locations shown during checkout.
    2. The estimated delivery time is displayed before you place your order and may also be included in the order confirmation.
    3. Unless another delivery period has been agreed, we will deliver the order within 30 days after the agreement is concluded.
    4. If delivery is delayed, we will inform you as soon as reasonably possible.
    5. If we fail to deliver within the agreed period or within a reasonable additional period provided by you, you may cancel the purchase. We will then refund the relevant payments.
    6. Delivery is completed when you, or a third party appointed by you, physically receives the product.
    7. The risk of loss or damage remains with Musthavz until the product has been delivered to you.
    8. If you personally select a carrier that was not offered by us, the risk may transfer when the product is handed over to that carrier.
    9. You are responsible for providing a complete and correct delivery address. Additional costs caused by incorrect or incomplete delivery information may be charged to you where reasonable.


    Article 7 — Inspection Upon Delivery

    1. Please inspect the order as soon as reasonably possible after delivery.
    2. If the parcel or product is visibly damaged, incomplete or incorrect, please contact us promptly at contact@musthavz.com.
    3. When reporting an issue, please provide:
    • your order number
    • a description of the issue
    • clear photographs, where relevant

    -Not reporting an issue immediately does not automatically remove any statutory rights you may have.


    Article 8 — Right of Withdrawal and Returns

    1. As a consumer, you have a statutory right to withdraw from an online purchase within 14 days without giving a reason.
    2. The withdrawal period begins on the day after you, or a third party appointed by you, receives the product.
    3. Musthavz voluntarily extends the return period to 30 days, subject to the conditions stated in our Returns & Warranty Policy.
    4. You can register a return through your Musthavz account or use the clearly identifiable online cancellation function available on our website.
    5. You may also notify us of your withdrawal by sending an unambiguous statement to contact@musthavz.com.
    6. After notifying us of your withdrawal, you must return the product within 14 days.
    7. During the statutory withdrawal period, you may inspect the product in the same way you would in a physical shop. You are responsible for any loss in value resulting from handling beyond what is reasonably necessary to determine the product’s nature, characteristics and functionality.
    8. Unless otherwise stated, the direct cost of returning an unwanted product is your responsibility.
    9. Return costs are covered by Musthavz when:
    • the product is defective
    • an incorrect product was delivered
    • the return is required due to an error on our part
    • applicable law requires us to cover the costs

    Article 9 — Refunds

    1. Following a valid withdrawal, we will refund all payments received for the returned purchase, including the cost of standard delivery where legally required.
    2. If you return only part of an order, the original delivery costs will generally not be refunded.
    3. If you selected a more expensive delivery option than our standard delivery method, we are not required to refund the additional delivery cost.
    4. We may withhold the refund until we have received the returned product or until you provide evidence that it has been shipped, whichever occurs first.
    5. Refunds will be made using the original payment method unless another method is expressly agreed.
    6. We will not charge a fee for issuing the refund.
    7. Once processed by us, it may take approximately 3–5 business days for the refund to appear, depending on your payment provider.


    Article 10 — Exceptions to the Right of Withdrawal

    The statutory right of withdrawal may not apply to certain products where an exception is permitted by law, including:

    • products made to your specifications or clearly personalised
    • sealed products that are unsuitable for return for health or hygiene reasons after the seal has been broken
    • products that, by their nature, have become inseparably mixed with other items after delivery
    • sealed software, audio or video products after the seal has been broken

    -Where an exception applies, this will be clearly stated on the product page before purchase.


    Article 11 — Statutory Guarantee and Commercial Warranty

    1. Products sold by Musthavz must meet the agreement and perform as you may reasonably expect.
    2. Under Dutch law, the statutory guarantee does not have a fixed duration. Its duration depends on the type of product, its price, the information provided and its reasonably expected lifespan.
    3. If a product is defective or does not meet reasonable expectations during its expected lifespan, you may be entitled to a free repair or replacement and, where appropriate, a price reduction or refund.
    4. Most Musthavz products also include a one-year commercial warranty covering manufacturing defects.
    5. This commercial warranty is additional to your statutory rights and does not limit or replace them.
    6. Damage caused by misuse, accidental damage, improper installation, unauthorised modifications or normal wear and tear is not covered by the commercial warranty.

    Article 12 — Complaints

    1. If you have a complaint about a product, order or our service, please contact us at contact@musthavz.com.
    2. Please include your order number and a clear description of the complaint.
    3. We will acknowledge your complaint and aim to provide a substantive response within 14 days.
    4. If more time is reasonably required to investigate the complaint, we will inform you within that period and indicate when you can expect a response.
    5. We encourage you to contact us first so that we have an opportunity to resolve the matter directly.
    6. For cross-border disputes within the European Union, consumers may also contact the European Consumer Centre in their country for information and assistance.


    Article 13 — Customer Account

    1. You may be able to create or access a Musthavz account to view orders and request returns.
    2. You are responsible for keeping your login details and access codes confidential.
    3. Please inform us promptly if you suspect unauthorised access to your account.
    4. We may temporarily block an account when reasonably necessary to prevent fraud, misuse or security risks.
    5. Blocking or closing an account does not affect rights and obligations arising from orders already placed.


    Article 14 — Liability

    1. Musthavz is responsible for loss or damage that is the foreseeable result of our failure to comply with the agreement or applicable law.
    2. We are not responsible for loss or damage caused by:
    • incorrect or incomplete information supplied by you
    • use of a product contrary to its instructions or intended purpose
    • incompatibility that was clearly disclosed before purchase
    • unauthorised modifications or repairs
    • circumstances that are not reasonably attributable to Musthavz

    -Nothing in these Terms & Conditions excludes or limits liability where exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud, deliberate misconduct or mandatory product-liability obligations.

    -These Terms & Conditions do not limit your statutory consumer rights.


    Article 15 — Force Majeure

    1. Musthavz is not responsible for delays or failure to perform caused by circumstances beyond our reasonable control.
    2. Such circumstances may include natural disasters, war, terrorism, strikes, government measures, epidemics, transport disruption, cyberattacks, major network failures and serious supply-chain interruptions.
    3. We will inform you as soon as reasonably possible when such circumstances materially affect your order.
    4. If performance becomes impossible or is delayed for an unreasonable period, you may cancel the affected part of the agreement and receive a refund for products not delivered.


    Article 16 — Intellectual Property

    1. All intellectual-property rights relating to the Musthavz website, brand, logos, product photography, text, designs, graphics and other content belong to TeleQare Europe B.V., its licensors or the relevant rights holders.
    2. You may view and use the website for personal, non-commercial purposes.
    3. You may not reproduce, distribute, modify, publish or commercially use website content without prior written permission, except where permitted by law.


    Article 17 — Personal Data

    1. We process personal data in accordance with the General Data Protection Regulation and other applicable privacy laws.
    2. Information about how and why we collect, use, retain and protect personal data is available in our Privacy Policy.
    3. Our Privacy Policy is separate from, but should be read together with, these Terms & Conditions.


    Article 18 — Changes to These Terms

    1. We may amend these Terms & Conditions when reasonably necessary, for example due to changes in law, our website or our services.
    2. The version applicable to your purchase is the version made available to you when you placed the order.
    3. Changes made after an order has been placed will not retrospectively reduce your contractual or statutory rights.


    Article 19 — Severability

    If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be replaced or interpreted as closely as legally possible to reflect its original purpose.


    Article 20 — Governing Law and Disputes

    1. These Terms & Conditions and agreements concluded through the Musthavz website are governed by Dutch law.
    2. This choice of law does not deprive consumers living in another country of any mandatory consumer protection provided by the laws of their country of residence.
    3. Disputes may be submitted to a competent court in accordance with applicable law.
    4. Before starting formal proceedings, we encourage both parties to make a reasonable effort to resolve the matter directly.
